And yeah, Toni's voice is nice; I just think the 'Phantom' role of the song needs to be more powerful than melodic.

Having spent a sad amount of time over at the Nightwish forum, where this issue has been discussed extensively several times, I have grasped enough of copyright law to know that she only needs Nightwish's permission to perform "Nemo" and "Passion and the Opera" if she wants to record it for a CD or DVD. Since this online concert is free, and includes Passion and the Opera, I conclude that she doesn't need permission provided she doesn't intend to make money from the recordings. Indeed, just as NW can continue to use her backing vocals in their concerts. Yes, they CAN, but they don't. They rerecorded the neccessary tracks, with Anette in most cases, and the orchestra/choir for Wishmaster. Again with the Nightwish forum thing, there was a big "thing" over this when someone said Tarja had said it. There had been an article ages ago saying that the band had rerecorded the backing tracks or something, and it sort of descended into an argument, eventually Tuomas posted to confirm, they DID rerecord them. I assume that Tarja was misinformed about it, I can't see any reason for her to deliberately make it up.

Bloody hell, the things people will get into arguments about. Kind of sad if you think about it, no?
It's been a huge issue in the YouTube comments as well, and people are throwing the most amusing hissy fits.
Anyhow, I'm very pleased that Tarja is still performing NW stuff, especially things like PatO, which, as far as I have gathered, hadn't been included in concerts for a while.
And as for copyright - pfsha!

[/childish attitude] I have come to the conclusion that, great band that Nightwish is, and great singer that Tarja is, some of their fans are tugging down the general IQ of humanity. Like I said above, I don't see why she had any reason to make it up, and if she did, so what? It's not like these people's life hinges on whether she told the truth or not. I can understand Tuomas being pissed off about it, maybe, but methinks some fans take stuff far too personally when it comes to an artist they like. And yeah, I can't recall seeing any vids of PatO live since 1999, and then Tarja missed off the end because she had real difficulty with it, so it's nice that we have the oppurtunity to hear it again live, albeit with a slightly different take on the music. Tuomas hasn't complained about her singing them, either way, so it's not like there's a great moral objection to it.

I think a lot of the backing vocals in The Siren were done by the choir, as well as Tarja, I assume they didn't bother rerecording those *shrugs*.
Again, I'm working on the basis that Tuomas is telling the truth, but what he posted was pretty conclusive about it.
"All the backing tracks have been re-recorded with Anette singing them. You don`t hear a note of Tarja in the live shows, not a breath in any of the old songs. I can`t believe anybody thought we would do that"
Twas pretty surprising when he posted actually, LOL, the members post so very rarely on there.

The new choir thing for it is rather... different. Anyway, in other news, Tarja's tour kicks off TONIGHT! *glee* In fact, the first show's probably just finished. An hour or so ago...

Ah, yes, WM's backing is very different, LOL, though I really like it. From what I recall from Youtube videos, you can sort of tell on DCOW, mostly because of it missing Tarja's introductory "Once I had a dream..." bit. I remember Sleeping Sun being particularly noticeable, too, but they don't seem to be playing that anymore. Beyond that, I can't make out.
Anyway, first concert has finished, this was the setlist, apparently, according to the tt forum:

Twas pretty surprising when he posted actually, LOL, the members post so very rarely on there. The only band I've seen with a member that posts on the forums a lot is DragonForce, with the member being their keyboardist. He's a bit of an odd chap, uses AOL speak a lot. As for the backing vocals live, mayhaps they found a Tarja soundalike? Do they have Stars in their Eyes in Finland?

DSO post on their forum a lot, if my memory serves me correctly. Bless them. Yep, some of them do, I believe there are at least 2 members of Epica that post on their forum a mental amount. NW members don't do so that often, though, which is why pages of comments tend to spring up whenever one does, LOL. Wilska posts on there a lot (male vocals on Pharaoh Sails to Orion, Devil and the Deep Dark Ocean and 10th Man Down), but I guess he doesn't count as he isn't technically a band member.
